PREAMBLE:-
Vazhakkad Darul-Uloom Association has made application to SRC-NCTE for establishment of darul Uloom Training College, vazhakkad P.O. Pin-673640,Malappuram District, Kerala for offering B.Ed course on 31.12.2002.
The application has been pending with SRC because of the public Interest Litigation filed in the Hon’ble High Court of Kerala, against the decision of the Kerala Governmentin restricting the number of NOCs and revising the earlier list of institutions with NOC.The visit has been caused to this institution as per the directions of the Hon’ble Supreme courtof India vide C.A. Nol.3666 of 2005.
Pursuant to receipt of Supreme Court order for the said institution, an inspection was carried out to the institution for B.Ed course on 25.08.2005.
The inspection report was placed before southern Regional Committee of NCTE in its 100th meeting held on 23-24 September 2005. Considering the inspection report as well as other materials furnished by the institution, SRC decided to accord recognition to the institution from the session 2006-2007 for B.Ed course as the endorsement submitted by the institution is dated 03.10.2005 which is belated for being considered for the current academic year 2005-2006 as per Appendeix -1B OF NCTED regulations, 2002.
However, SRC decided to grant recognition to the institution for the current academic year 2005-2006 due to the following reason:-
In the earlier meetings, SRC decided to grant recognition for institutions which have submitted belated documents to be eligible for the year 2006-2007. However, some institutions who have been granted recognition for the subsequent year based on belated endorsements preferred an appeal to NCTE Hqrs and contended that a few institutions which have submitted belated endorsements were granted recognition for the current academic year. SRC, in its comments to the NCTE Hqrs explained that this has occurred due to oversight and would modify such orders, which have been wrongly issued. Pursuant to this, the National Council for Teacher Education, New Delhi, No.F.No.89-156/2005-Appeal dated 28th September, 2005 remanded back the cases to the SRC, Bangalore with a direction to reconsider the cases who have been granted recognition for 2005-2006.
The same was placed before SRC in its 103 rd meeting held on 27-28 October, 2005 and SRC after obtaining a considered legal opinion in this regard , took a decision to review its recognition orders issued for the session 2006-07 and to grant recognition for the session 2005-06 to those institutions who have submitted belated NOCs/Endorsements as one time exception. Subsequently, SRC in its 104th meeting held on 9-10 november 2005 has decided to extend this one time relaxation to other institutions who have submitted other documents mentioned in appendix-1 B of the NCTE Regulations, 2002 belatedly.
Hence the modified order:

ORDER
| In terms of Section 14(!) of the NCTE Act , 1993 Darul Uloom Training College, Vazhakkad P.O. Pin-673640, Malappuram District, Kerala had submitted an applicat8ion to the southern Regional Committee of NCTE for grant of recognition for starting Secondary course of one year duration from the academic session 2005-2006 with an annual intake of 100 students. |

On scrutiny of the application submitted by the institution, the documents attached therewith and the input received from the visiting team, the Committee has noted the following: |

a) |
The institution has acquired the land for setting up the teacher education institution. |
| |
b) |
The institution has constructed the building for conducting the course on the above mentioned land. |
| |
c) |
The institution has created an Endowment Fund of Rs.5.00 Lakhs and a Reserve Fund of rs.3.00 Lakhs. |

d) |
The institution has selected the principal/Head and seven teachers for the said course. |

Now, therefore, in exercise of the powers vested under 14(3)(a) of the NCTE Act, 1993, the Regional Committee hereby granmts recognition to Darul Uloom training College, vazhakkad P.O. Pin-673640, Malappuram District, Kerala for Secondary course of one year duration from the academic session 2005-2006 with an annual intake of 100 students subject to fulfillment of the following:

A) |
The institution will ensure that eight exclusive faculty members (principal/head and seven teachers) are in position for an intake of 100 students, duly approved by Calicut University and a report to this effect shall be sent to the Committee immediately and in any case before the commencement of the admissions. |

B) |
The institution shall, within one month of the receipt of recognition order, convert the endowment fund account into a joint account to be operated along with an official of the Regional Committee. |
| |
C) |
The institution shall shift to its own premises within three years from the date of recognition (in case the course is started in temporary premises). |
| |
D) |
The institution shall comply with the various other norms and standards prescribed in the NCTE Regulations.

| |
Further, the recognition is subject to fulfillment of all such other requirements as may be prescribed by other regulatory bodies like UGC /University/ state government etc. |
| 5. |
|
|
| |
The institution shall submit to the Committee a performance Appraisal Report at the end of each academic year along with a copy of the approval of the affiliating University for the appointment of faculty members and the statement of annual accounts duly audited by a Charted accountant. |
| 6. |
|
|
| |
if the institution contravenes any of the above conditions or any the provisions of the NCTE Act, Rules, Regulations and Orders made or issued the under, the Regional Committee may withdraw the recognition under the provisions of Section 17(1) of the NCTE Act. |
